Acceptance of Terms

By accessing and using Appify.it ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Service Description

Appify.it provides Shopify mobile app development services, including but not limited to:

• Custom mobile app development for Shopify stores
• iOS and Android app creation and publishing
• Push notification marketing services
• Customer analytics and insights
• Live app editor and customization tools
• Shopify integration and synchronization

Trial Offer Terms

• Trial Period: 90-day free trial period
• Trial Cost: $1 USD refundable trial fee
• Regular Pricing: $27/month after trial period
• Cancellation: You may cancel anytime during the trial period
• Refund Policy: 100% refund of the $1 trial fee available during trial period - no questions asked
• Auto-renewal: Service automatically renews at $27/month unless cancelled

Fair Usage Policy

• Base Plan: $27/month includes unlimited access to all features
• Mobile Order Volume: Orders received via your mobile app are subject to fair usage policy
• Platform Fee: 1.8% fee applies to mobile order volumes exceeding $3,000 per month
• Fee Calculation: Only applies to the portion exceeding $3,000 (e.g., $5,000 in mobile orders = 1.8% of $2,000)
• Billing: Platform fees are calculated and charged monthly based on actual mobile order volume
• Transparency: All fees are clearly displayed in your monthly billing statement

Payment Terms

• Payment is processed securely through our payment partners
• All prices are in USD unless otherwise stated
• You authorize us to charge your payment method for the trial fee and subsequent monthly fees
• Failed payments may result in service suspension
• Price changes will be communicated 30 days in advance

Cancellation and Refunds

• You may cancel your subscription at any time through your account dashboard
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months of service
• Trial period refunds are available upon request
• Upon cancellation, your app will remain functional until the end of the billing period

User Responsibilities

• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• You must comply with all applicable laws and regulations
• You may not use the service for illegal or unauthorized purposes
• You must not interfere with or disrupt the service

Privacy and Data

• Your privacy is important to us. Please review our Privacy Policy
• We collect and process data as described in our Privacy Policy
• We implement appropriate security measures to protect your data
• We do not sell your personal information to third parties
• You consent to receive marketing communications as outlined in our Privacy Policy

Data Retention & Deletion

• You may contact us at any time to request removal of your data from our systems. Please email apps@gitspark.com with your request.
• If you uninstall our app, we will redact or anonymize all personal identifiers associated with your account within 90–180 days of uninstallation.
• Some non-personal, aggregated, or anonymized data may be retained for analytics, legal, or security purposes as permitted by law.
• This policy is in addition to your rights under our Privacy Policy and applicable data protection laws.

Intellectual Property

• You retain ownership of your store content and data
• We retain ownership of our platform, technology, and intellectual property
• You grant us license to use your store data for service provision
• Custom apps created through our service belong to you

Service Availability

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• We may perform maintenance that temporarily affects service availability
• We are not liable for service interruptions beyond our control
• We will provide advance notice for scheduled maintenance when possible

Warranty Disclaimer

The Appify.it platform and all related services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or meet your specific requirements.

Limitation of Liability

To the maximum extent permitted by law, Appify.it shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

Indemnification

You agree to defend, indemnify, and hold harmless Appify.it and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the service.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Appify.it operates, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the service. Your continued use of the service after such modifications constitutes acceptance of the updated terms.

Eligibility & Service Scope

• Eligibility: This offer is only available to merchants with an active Shopify store.
• Service Scope: We do not build, modify, or manage your Shopify web store, including but not limited to your store's inventory, products, or any marketing services.
• Our service is solely the provision of a mobile app builder platform that integrates with your existing Shopify store.
